These Terms of Use (the “Terms”) govern your access to and use of the VitalCore Health websites and online services (collectively, the “Website” and “Services”), owned and operated by Randbast, LLC d/b/a VitalCore Health (“VitalCore Health,” “VCH,” “we,” “us,” or “our”).
By accessing or using the Website or Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use the Website or Services.
Even if you arrive at the Website through a third party (including an affiliate), you understand and agree that these Terms are entered into between you and VCH.
VitalCore Health is the merchant of record for purchases made through our Website and online store.
NO MEDICAL CARE BY VCH: VCH does not provide medical advice or medical care. Any clinical services (including evaluations, diagnosis, treatment, prescribing decisions, ordering of diagnostic tests, and clinical advice) are provided exclusively by independently licensed healthcare providers and/or professional entities (the “Providers”), who are solely responsible for your clinical care and medical judgment.
THIRD-PARTY TELEHEALTH PLATFORMS: If you access clinical services through a third-party telehealth platform (including Telegra), your use of that platform and any clinical services will be governed by the applicable third party and Provider terms, policies, and consents. VCH does not supervise, direct, or control Providers or their clinical decisions.
By using the Website or Services, you acknowledge and agree that:
You must be at least 18 years old to use the Website or Services. By using the Website or Services, you represent and warrant that you are at least 18 and that you have the legal capacity to enter into these Terms.
The Services are offered only in certain states and may change from time to time at our discretion. We do not represent that the Website or Services are appropriate or available in all locations.
To access certain Services, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account by emailing help@vitalcore-health.com.
VCH provides non-clinical services such as e-commerce purchasing, subscription administration, customer support, and coordination of order-related logistics. VCH may also provide technology and operational support that helps you connect to independent Providers through third-party platforms.
VCH’s e-commerce systems may receive operational order status updates (for example: processing, on-hold, completed, refunded, or similar). VCH’s e-commerce systems are not designed to collect or store HIPAA-regulated protected health information (“PHI”).
Automatic Renewals: Certain products and services are offered on an automatically renewing subscription basis until you cancel.
Quarterly Provider Check-Ins: For GLP-1 medication subscriptions, each plan requires a quarterly Provider check-in to help support safe and effective progress. The cost of these check-ins may be included in your subscription price as described at checkout and in your account.
Early First Renewal Charge (Up to 10 Days): To help avoid interruptions in access and to maintain a buffer for quarterly check-ins and potential shipping delays, your first subscription renewal may be charged to your payment method up to 10 days early. After this first early charge, your subscription will bill on its regular schedule (for example, every 1 month, every 3 months, or every 6 months, depending on your plan).
Cancellation: You may cancel at any time before your next billing date, subject to any applicable processing timelines disclosed at checkout and in your account. Cancellation stops future renewals but does not automatically entitle you to a refund for amounts already billed, except where required by law or expressly stated in a written refund policy.
Authorization: By providing a payment method, you authorize VCH (and our payment processors) to charge your payment method for recurring subscription fees, applicable taxes, shipping, and any other charges you authorize.
You agree to pay all fees and charges associated with your purchases and subscriptions. All sales are final except where required by law or expressly stated in a written refund policy. For questions about billing, contact help@vitalcore-health.com.
You consent to receive communications from us electronically (for example, via email, SMS, or through your account), including transactional notices about your orders, subscriptions, billing, and customer support.
Marketing communications (email/SMS) will be sent only in accordance with applicable law and your choices and consents. You can opt out of marketing messages at any time by using the unsubscribe link in an email or replying STOP to a marketing text message (where applicable).
You agree not to misuse the Website or Services. You will not:

VitalCore Health makes no guarantees regarding outcomes, results, or benefits associated with any product, subscription, or service. Individual experiences vary, and results are not guaranteed.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, VCH AND ITS AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE WEBSITE OR SERVICES.
TO THE EXTENT PERMITTED BY LAW, VCH’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO VCH IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
VCH will not be liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, supply chain disruptions, governmental actions, or failures of utilities or communications networks.
You agree to indemnify, defend, and hold harmless VCH and its affiliates, officers, directors, members, managers, employees, agents, and licensors from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Website or Services or your violation of these Terms.
The Website and its content (including text, graphics, logos, images, and software) are owned by VCH or its licensors and are protected by intellectual property laws. You may not use, copy, modify, distribute, or create derivative works from the Website content except as expressly permitted by these Terms.
If you submit feedback, suggestions, ideas, or other content to VCH (collectively, “Feedback”), you grant VCH a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any lawful business purpose without compensation to you.
We reserve the right to suspend or terminate your account, refuse service, or limit access to the Website or Services at any time if we believe you have violated these Terms, misused the Services, provided false information, or engaged in unlawful, fraudulent, abusive, or harmful conduct.

To the fullest extent permitted by law, you and VCH agree that any dispute arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration and not in court, except that either party may bring a claim in small claims court if it qualifies.

We may update these Terms from time to time. The “Last Updated” date above indicates when these Terms were last revised. Your continued use of the Website or Services after changes become effective constitutes acceptance of the revised Terms.
